تندرج الدراسة ضمن الدراسات الإنسانية و القانونية، المعنية بحقوق الإنسان، و قد تصدرها فصل تمهيدي، تضمن إطلالة على كل من الإعلان العالمي لحقوق الإنسان و دستور دولة الإمارات، لمعرفة سماتهما العامة و حرصهما على إقرار و تعزيز حقوق الإنسان و حرياته الأساسية، لا سيما فيما يتعلق بمبدأ "أصل البراءة" و ما يرتبط به من حقوق و حريات أخرى.
تناول الفصل الأول التعريف بمبدأ أصل البراءة، و تحديد مصادره الدينية و الدولية و الإقليمية و الوطنية، و أساسه القانوني، و انعكاساته في المنظومة الدستورية و القانونية لدول الإمارات، بينما تطرق الفصل الثاني إلى عدد من الموضوعات التي ترتبط مباشرة بمبدأ أصل البراءة، و التي تتمثل في المحاكمة العادلة، و عبء الإثبات، و اليقين القضائي.
و قد تم تناول موضوعات الدراسة من خلال منظور مقارن يعتمد على التحليل الموضوعي للمبادرات الدولية و الإقليمية في مجال حقوق الإنسان (الإعلان العالمي لحقوق الإنسان و غيره من المواثيق الدولية و الإقليمية ذات الصلة)، و متابعة أثرها في المنظومة التشريعية لدولة الإمارات، الأمر الذي أكد على توافق بين أحكام هذه المنظومة، و الاتجاهات القانونية المعاصرة للمجتمع الدولي، بشأن احترام مبدأ "أصل البراءة في الإنسان"، و توفر الضمانات و الآليات اللازمة لإنفاذه على النحو المنشود.
و قد خلصت الدراسة إلى بيان مدى حرص دولة الإمارات العربية المتحدة على إقرار و تعزيز و تفعيل مبدأ أصل البراءة المفترض في كل إنسان.
Abstract EN
This study is a legal and anthropologic one which deals with human right issue.
It its introductory chapter, study sheds light on Universal Declaration of Human Rights and UAE constitution in a bid to identify their general features and commitment to boost human rights and fundamental freedoms.
The first chapter defines presumption of innocence principle setting forth its religious, international, regional and national sources in addition to its legal base and reflections on UAE's constitutional and legal system.
Second chapter deals with a host of issues related directly to the presumption of innocence, like, fair trial, burden of proof and judicial proof.
The study adopts a comparative perspective based on subjective analysis for the international and regional initiatives in the arena of human rights; International Declaration of Human Rights and other related international and regional conventions and then traces its impact on UAE legislative system.
Study found that UAE legislative system goes in tandem with contemporary legal trends of the international community as regards ( presumption of Innocence), and that all required mechanisms and assurances to execute this principle are available.
Study sums up with that UAE is committed to adopt and activate principle of Presumption of Innocence.
