UAE laws haven’t yet regulated the framework of occupying public positions.
However, the Federal Law No 11 for the year 2008 regarding human resources had distinguished between two different policies.
Before the emergence of such law, all managements used to select and hire their employees on their own volition as per the provisions of civil service law No 21 for the year 2001.
Article 20 of the new law had provided that occupying positions from grade 1 to 10 should be by means of advertisement in which all required qualifications are stated.
By the emergence of this new law, new legislative features of occupying public positions began to appear in the horizon.
The article 15 of the said new law provides that applicants should successfully pass all related job tests and interviews.
Whereas, Article 13 gives the minister the right to appoint whom he deems fit to occupy certain vacant top jobs with special contracts.
Thus, the new law strikes balance between free selection and application systems, and moreover distinguishes between different types of jobs according to the qualifications of applicants.
Additionally, it takes into consideration full time and part time recruitment, and as for employees under probation, the new law sets forth more exhaustive details than its predecessor the civil service one.
