Abstract EN

The study of the government legal proceedings’ taw number 25 of the year 1958 aims to show how the Jordanian legislator in the East bank was influenced by the Palestinian legislator under the British mandatory administation over the two banks of the River Jordan; and that the Jordanian legislator adopted Palestinian laws some of which are still in force with some modifications, one of such laws is the law under discussion.

The study shows that the adherence to this law is unjustified The study makes clear that this law is unconstitutional because it limits the right to litigate which the Jordanian constitution made unlimited (articles 101,102).

The study also shows that the Jordanian Jurisdiction represented by The Court of Cassation disregarded this law in favor of the constitution and made litigation unlimited.

The study concluded that the government legal proceedings, saw is no longer applicable oithough it is still in force theoretically, the study susgests that the Jordanian lagel system must logically abandon this law,and give people the eight to sue the government according to the general rules without limitation.
