Abstract AR
إن منح مجلس الأمن الدولي سلطة الإحالة إلى المحكمة الجنائية الدولية يعتبر تطورا جديدا للعدالة الجنائية الدولية.
تحاول هذه الدراسة، تسليط الضوء على هذه السلطة من خلال تحليل نصوص نظام روما الأساسي و أحكام ميثاق منظمة الأمم المتحدة ذات الصلة.
هي فرصة للتساؤل حول معرفة الطبيعة القانونية لهذه السلطة و حدودها و مدى تأثيرها على ولاية و استقلالية المحكمة في ممارسة وظيفتها القضائية.
Abstract EN
The power of referral of the International Criminal Court granted to the Security Council of the UN is a new development in international criminal justice.
This study attempts to shed light on this power from the Rome Statute and the provisions of the Charter of the United Nations.
This article is about the nature and limits of the referral and its impact on the competence and independence of the Court in the exercise of its judicial power.

Le pouvoir de saisine de la Cour pénale octroyé au Conseil de sécurité de l’ONU, constitue un nouveau développement de la justice pénale internationale.
Cette étude tente de mettre la lumière sur ce pouvoir, à partir de l’analyse du Statut de Rome et des dispositions de la Charte des Nations Unies subséquentes.
Il sera question de s’interroger sur la nature et les limites de cette saisine et son impact sur la compétence et l'indépendance de la Cour dans l'exercice de son pouvoir judiciaire
