الادعاء المباشر هو إجراء مكتوب موجه لأحد أطراف الخصومة تعلن المحكمة فيه عن ساعة، تاريخ الجلسة، مكانها، الهدف من الحضور ووصف محل النزاع.
لضمان حقوق الدفاع لأن التكليف إجراء من إجراءات التحقيق بعد رفع الدعوى قضائيا.
و قد حصر المشرع الجزائري حالات الادعاء المباشر في خمس حالات، من خلال المادة 337 من قانون الإجراءات الجزائية الجزائري.
Abstract EN
The private prosecution is a written procedure to either party in litigation, with which the court of first instance declares the date, time and place of the hearing, thus the aim of presence and description of the claim, to protect the rights of defense because the summon is an investigation procedure after the deposit of the complaint to legal services.
The Algerian legislator has limited private prosecution in five cases in the article 337 of the Algerian Criminal Procedure Code.

La citation directe est une procédure écrite pour l’une des parties au litige, par la quelle le tribunal déclare la date, l’heure et le lieu de l’audience, ainsi que l’objectif de la présence et la description du litige.
Pour garantir les droits de la défense, l’assignation est une procédure d’enquête après le dépôt de la plainte devant les services juridiques.
