English Abstract

The males’ right to have conditions in the marital contract : This study aims for shedding the light on the mans right to have conditions in the marital contract in Islamic Fiqh and its legal Implementations in the Jordanian personal affairs law.

I First started by talking about the origin of this right, by taking the Islamic verses into consideration it Juries prudential practices in Jordanian share, it courts the study showed that this right is legally guaranteed and that it has its legislative effects.

The study asserts also that this right is originally stated in Hanbaly jurisprudence.

The study consisted from an introduction and two chapters and a conclusion and recommendations.

The introduction dealt with this right historically then we talked about specific right and its types followed by marriage conditions from a linguistic and Islamic point of view.

At the first chapter we shed the light on the different jurisprudential schools and their proofs then we discussed it and its effect in Islamic jurisprudence.

The second chapter talked about the mans right to have conditions in the marital contract in the Jordanian personal affairs law and the implementations with results and discussion in the end of the study.
