English Abstract

The study aimed to identify the freedom of opinion and judicial oversight to practice as a comparison study between the Egyptian and Jordanian legislation and Oman.

For the purposes of achieving the objective of the study was divided study to the front and two chapters, where he was addressing the problem of the study and its importance, objectives and previous studies and methodology in the foreground, in the first chapter of legal regulation of freedom of opinion, and we dealt with the essence of freedom of opinion, and to identify control on freedom of opinion and types.

In the second chapter contained restrictions on freedom of opinion and we dealt with the constitutional limitations on the freedom of opinion, and legal restrictions on the freedom of opinion.

The researcher used the descriptive method in the study That the rule of freedom in society does not give him immunity and prevent it from the outside inward, but instilled in that particular citizen's sense of personal independence and respect for his humanity.

And that is not based on democracy without the rule of law, not only be a reality in the country where censorship on the constitutionality of laws.

And is eliminating a pillar of the state and stops him real control to achieve the desired protection of human rights This will take judicial oversight into reality, and the implementation of judicial decisions the need for the stability of the legal rights and centers.

The aim of judicial oversight to maintain the legal construction of the state, which is the cornerstone of the Constitution of this building.

And control over the constitutionality of laws, whether through direct control or other form of guarantee for the protection of the rights and freedoms from the encroachment of the executive or legislature., And a variety of types of judicial oversight and control is the political, parliamentary oversight, and administrative control.

Freedom of opinion and expression of the most sacred of human rights, which is necessary for the exercise of freedom of many other rights.

Our mission is concentrated on freedoms in the legislation in Jordan, Oman, compared to the Egyptian legislation.

And returns a reference fundamental freedoms in Jordan to the Jordanian Constitution, promulgated in 1952, the Jordanian Constitution has provided constitutional and legislative guarantees of human rights.

The freedom of opinion is guaranteed in Article Fifteen of the Jordanian Constitution.

The freedom of the press is guaranteed in accordance with paragraphs 3 and 4 of Article 15 of the Jordanian Constitution.

The Jordanian Constitution guarantees in Article 16 of the freedom of assembly and association within the circle of the law.

And applies it to the Sultanate of Oman began her career development on July 23, 1970, and select the Statute of the Sultanate of Oman basic aspects of life, it has included the following elements and the type of detail addressing the social ladder, and the administrative system and public funds, and the relationship between the public sector and the private sector, economic development, Family is the foundation of society, public health, nationality and citizenship, and the protection of human rights, and the independence of the judiciary, freedom of housing, freedom of opinion and expression, freedom of the press and publishing, and respect for international conventions.

The constitutions of Egypt confirmed since the Constitution of 1923 and the Constitution (1971), which provided for the many freedoms it: freedom of opinion and expression, freedom of the press, printing and publication, freedom of scientific research, the right of assembly, the right of association, the right to form trade unions.
