English Abstract

Most construction projects in Gaza Strip are suffering from claims due to borders closure and shortage of materials in markets.

Claims emergence has risen since 10 years due to critical political situation.

These claims have a bad effect on all parties whose working in construction sector.

The effects of claims could be traced to cost overrun, loss of efforts, and suspension of work, contract termination.

The aim of this study is to identify the major causes of claims in construction projects in the Gaza Strip, claims types frequency, methods of minimizing claims in construction project and show if there is a significance differences in views between respondents regarding personal, company, and organization traits.

It also aims to develop a mathematical model for management of construction project claim in order to predict claim occurrence and to mitigate the negative impact of claim.

The objectives of the study were achieved through a valid questionnaire that was obtained from client organization; UNRWA engineers working in construction and design units working in construction projects in Gaza Strip, and contractors who have a valid registration and classified 1st and 2nd in building.

The results showed that the most important factors that contributed to the causes of claims are; concurrent closure of borders due to political situation, Design error or omissions, Suspension of work, Shortage of material and high raising of its price, and contract ambiguities.

The results show also the most frequent claim type was the "Extra Work Claim".

The results showed methods to minimize claims; adequate contract management, no ambiguities in contract document, available source of finance, qualified and competent project manager.

Model was established by using factor analysis from a stepwise multiple regression analysis on the claim factors.

The study recommended clients to use the developed predictive model to measure claim occurrence of project, Good planning along the life cycle of the project, Using a unified contract in all institutions in Gaza Strip, Seminars and training in claim and risk management to manage contract professionally
