Abstract EN

This research presents contemporary requirements to the development of Islamic transactional law.

It deals with the topic from different points reflecting : (1) the variables of time, place, man, interest and custom ; (2) the qualified jurist who can develop the notions ; (3) the subject of development which is the law of transactions in Islam ; (4) the development tool which can be seen in the adopted legal research methodology ; and (5) the environment wherein the development project applies, namely the business environment or the commercial market.

Thus we can say that the development requirements of transactional legal thought could be concluded in availability of five integrated factors : the incentives, the qualified jurist, the subject of development, the development instrument and the environment.
