يعتبر موضوع التعامل في التركة المستقبلة من الموضوعات الهامة و المستحدثة في القانون المدني الفلسطيني الجديد, بل و يعتبر التعامل في التركة عموما من أشهر أنواع التعاملات التي يتحتم على كل إنسان أن يتعامل بها سواء أكان بصفته وارثا ابتداء أم مورثا انتهاء.
و لعل التعامل ف التركة المستقبلة و إن كان من حيث الأصل محظور وفق التشريعات الفلسطينية و العربية, إلا أن المشرع الفلسطيني خرج عن هذا الأصل في القانون المدني الحالي, و أجاز بعض الاستثناءات التي يمكن عند تحققها أن يصبح التعامل بها حال حياته, فقد يعترض هذا النوع من التصرفات العديد من الإشكالات التي يكون من شأنها إما أن تجعله تصرفا صحيحا, أو باطلا بطلانا مطلقا لمخالفته للنظام العام و الآداب العامة, و هذا ما يناقشه موضوع البحث.
Abstract EN
Dealing in futuristic legacy is one of the important topics and developed in the new Palestinian civil law, but is generally handled in the most popular types of transactions, which is imperative for everyone to deal with, either as heir beginning or the end of the inheritor legacy.
Perhaps dealing with futuristic legacy albeit in principle is prohibited according to the Palestinian and Arab legislation, but the Palestinian legislature is out of this principle the current civil law, and permit some exceptions that can accrues to become a deal in the futuristic legacy permissible and tidy impacts Due to the accuracy of discrimination when dealing in the legacy after the death of inheritor, or mind the futuristic legacy the case of his life, oppose this kind of acts many of the problems that would either make it right act, or absolutely null and void for violating public order and public morality, and this is what being discussed on this research
