Abstract EN

The right of self-determination is one of the fundamental rights recognized in all international charters, and the issue of the right of self-determination of the peoples is the most important issue after the Second World War, when the development of international law and the emergence of human rights charters, gave it a new meaning to the principle of self-determination within the modern state.

The importance of this study is to clarify the reasons for the principle of self-determination, and its impact on the sovereignty of the modern state, and also what is the legal value of the principle of selfdetermination.

The study explain the concept of the right of self-determination in the theory and the concept of the modern state and legal value to the principle of self-determination, and the study explained the reasons and justifications for the right to self-determination, the researcher hired some models of self-determination in the continent of Africa Such as the application of self-determination in Western Sahara, and self-determination for Southern Sudan.
