Abstract EN

Commercial stores are are of great importance, both legally and economically, being the main medium through which merchants carry out their activities.

They have several qualitative and non-qualitative characteristics that harmoniously attract customers, thereby adding to the market value of the business enterprise.

Commercial jurisprudence has come to an understanding that commercial stores are a special kind of negotiable assets, thus requiring distinct treatment.

Many countries have put in place particular regulations that address the nature of commercial stores as an intangible negotiable asset, and regulate the various types of transactions to which they can be subjected.

Despite the aforementioned importance and international recognition, the Saudi judicial system clearly lacks proper regulations that define commercial stores and explicitly address the treatment of transactions in which they are involved.

In this paper, we first define commercial stores and clarify their components.

Second, we explain the rules that regulate them in the Saudi legal system and examine their adequacy.

We conclude with a number of results and recommendations such as how to introduce adequate regulations in Saudi Arabia that aim at properly governing such an important asset.
