The moral right of the author is considered as an essential element of intellectual property rights because it protects the author’s creation, in other words it is related to his / her personality.

Therefore, doctrine and jurisprudence did not allow the exploitation or mortgage of the moral right, they are inalienable rights.

Additionally, it is an eternal right that is related to the author even after death.

It also does not pass over to the author’s heirs.

The author is the only person allowed to perform the moral right; however this rule does have exceptions such as the collective work, and the employment contract signed between the author and the employer.
