التظلم الإداري في قواعد المرافعات أمام ديوان المظالم : دراسة تحليلية نقدية

Abstract EN

The Administrative Judiciary has, always been the last resort and most important and a powerful procedures, to protect the rights of individuals, from the abuse of the state.

therefore, the proceedings rules have helped the individuals to achieve their rights once be infringement by the state.

Although the positive side of the proceeding rules ,their negative side leads individuals not to obtain their rights.

in one side the regulation required people to complaint to the public authority first ,after this step, the may sue the public authority if it insist not to change its aggrieved decision.

In fact, most people are loosing their rights because the Board of Grievance refuses to proceed their case if they not follow such step.

this study provides suggestions to change those procedures and give solutions for the administrative complaining to be more flexible and justness.
