يشكل الدستور عملا مركبا يهندس المعادلة الثلاثية المتمثلة في السلطة و القيم و الثروة، كمام يرتب التفاعلات السياسية و ميزان قوتها على هيئة مقتضيات تحدد قواعد اللعب بين مختلف مستويات النظام المباشرة و غير المباشرة، و هو ما يجعله مفتوحا على فعل التفسير و مخاطر التأويل بحسب عاملي الزمان و المكان، و بحسب رجحان ميزان القوة إلى فائدة هذا الطرف أو ذاك.
و من هذا المنطلق، فإن الصياغة الدستورية، في معناها السكوني، لا تعني إيجاد قواعد ثابتة لموضوع ديناميكي متغير باستمرار، بل هندسة مرنة مجهزة بمقومات لوحة للقيادة تضمن السير العادي للمؤسسات الدستورية، و تعمل على ضمان التوازن.
ليس الدستور، إذا، مجرد عمل معياري اختزالي لأهم محاور الإصلاح السياسي، بل هو عمل قادر على وضع الإطار العام و تحديد الأهداف و المبادئ الأساسية، التي تكون لها القدرة على التكيف مع التحولات بقصد الاستفادة من الفرص المتاحة أو الممكنة، و التحكم في المخاطر المتوقعة و غير المتوقعة.
ما نخلص إليه من طرحنا مختلف هاته الاهتمامات في الصناعات الدستورية، هو نموذج تحليلي من أجل قياس الثابت و المتحول في الإصلاح الدستوري المغربي لسنة 2011 و تمفصلاته كفعل، لنرى ما إذا كان يعكس قيمة مضافة تتماشى و مقاصد الثورات العربية، أم أنه مجرد تحصيل حاصل من حيث نوعية مقتضياته في الأمور المرتبطة ببنية السلطة.
Abstract EN
Al- Ghali offers an in-depth analysis of Morocco’s constitution in light of the Arab Spring stressing the complex structure of a constitution that balances three key factors: authority, values, and wealth.
Constitutions also arrange political interactions and the balance of powers through basic principles that dictate the rules of the game between the various systems of governance, both direct and indirect.
This leaves the constitution open to interpretation and exegesis, taking into account issues such as space and time and the imbalances of power.
In this regard, a constitutional draft, in its static definition, does not mean the formation of fixed principles that govern an ever-changing and dynamic field.
Rather, it is a flexible structure that not only contains control mechanisms for the proper functioning of constitutional bodies, but also maintains the balance between them.
A constitution thus becomes more than a standardized work condensing the most important areas of political reform, becoming a text that can set the general framework, and lay down a set of basic aims and principles, which are in turn adaptable to change.
Against this backdrop, and following an analysis of various constitutional drafts, al-Ghali presents an analytical model for the determination and comparison of permanence and change within Morocco’s 2011 constitutional reform.
To this end, the author examined the constitution’s articles in order to assess the extent to which they add value in alignment with the aims of the Arab revolutions, or, alternatively, if those articles represent inconsequential changes to the structures of authority.
