Arabic Abstract

أظهرت هذه الدراسة بعض الأحكام الشرعية المتعلقة بالغلة، و بعض المسائل المعاصرة المرتبطة بها و التي لم يتطرق الفقهاء إلى بحثها و بيانها و تفصيلها، و بيان الحكم الشرعي في كل مسألة من مسائل الغلة ؛ حيث سلك الباحث في هذه الدراسة المنهج الو صفي المقارن ؛ حيث قام بجمع المسائل المتعلقة بأحكام الغلة في كتب الفقه قديمها و حديثها ؛ و من ثم عرض قوال الفقهاء في كل مسألة منها مع ذكر أدلة كل فريق ؛ و من ثم رجح الباحث القول الناجح في كل مسألة ؛ وفقا للمنهج العلمي المقارن في الترجيح ؛ حيث اختلفت أحكام الغلة وفقا لتنوع المسائل ؛ فكل مسألة لها حكمها الخاص مفصلة في موضعها ؛ و قد قام منهج الباحث على جمع الآيات القرآنية، و الأحاديث النبوية الشريفة، و أقوال الفقهاء من مصادرها الأصيلة، و تحليلها، ثم بينت الدراسة الحكم الشرعي لكل مسألة من هذه المسائل على حدة، و قد خرج الباحث الأحاديث النبوية الشريفة من مصادرها الحديثية الأصيلة، مبينا درجة كل حديث.

English Abstract

This study shows some doctrines that relate to incoming and some Contemporary cases that relate to incoming.

These cases the experts did not search or shows the rule which controls each case to incoming .

The researcher.

Used the comparative descriptive approach the researcher collected cases that are in books old and new .

then the researcher shows what the experts said in each case and he mentioned the evidences of each group the those experts.

After that the researcher preferred the preverding talk in each case according to comparative scientific approach in prevernce.

The incoming rules differd according to the kind of the case that is each case has its own ruls and this case explained in its position .

The approach of the researcher used theverses of the Holy Koran and the prophetic Hadith and the experts talks from their original sources then he analized these sources.

The study showed the doctrine to each case alone .

At last the researcher interprcted the prophetic Hadiths from their original sources and the rank to each Hadith .
