Arabic Abstract

خلصت في هذا البحث للتعرف على معنى الدستور، و طبيعة و ماهية الدساتير و نشأتها و طرق إصدارها و نهايتها قبل الخوض في موضوع الرقابة على دستورية القوانين و الأنظمة و هذا ما كان في التمهيد لهذا البحث.

إن وظيفة الدساتير الأساسية تتمثل في تنظيم السلطات العامة في الدولة، و تحديد العلاقة فيما بينها، و تحديد العلاقة بين الحكام و المحكومين و تحديد الشكل التمثيلي للدولة و المقومات السياسية و الاقتصادية الاجتماعية و الثقافية لها، و النص على الحقوق و الحريات العامة و كفالة احترامها و كفالتها و صيانتها و تتحقق الرقابة على دستورية القوانين و الأنظمة بصورتين : الصورة الأولى : الرقابة السياسية، و الصورة الثانية : الرقابة القضائية.

فيما يتعلق بالرقابة على دستورية القوانين و الأنظمة في الأردن فقد مرت بعدة مراحل، و إنه في ظل قيام الدولة الأردنية بالسير قدما في سبيل الوصول إلى الدولة القانونية، و أمام الكم الهائل من القوانين، و القوانين المؤقتة و الأنظمة، فإن وجود قضاء دستوري متخصص من خلال إنشاء محكمة دستورية بموجب تعديل دستوري أصبح ضرورة وطنية ملحة، و قد تحققت هذه الضرورة الوطنية من خلال تعديل الدستور لسنة 2011، حيث تضمن الفصل الخامس منه في المواد "58، 59، 60، 61" إنشاء محكمة دستورية.

و فعلا بتاريخ 7 / 6 / 2012 صدر قانون المحكمة الدستورية رقم 15 لسنة 2012، و نصت المادة الأولى منه على العمل به بعد مرور مائة و عشرين يوما على نشره بالجريدة الرسمية، و باشرت المحكمة الدستورية أعمالها بتاريخ 7 / 6 / 2012.

English Abstract

Before discussing the issue of the control over the constitutionality of laws and regulations، the introduction to this study addressed the meaning of the constitution، its nature، origins and methods of formulation.

The basic function of the constitutions is to organize the public authorities in the state and identify the relationships among them، determine the relationship between rulers and subordinates، select the representative form of the state، as well as the political، economic، social and cultural components of the state.

The basic function also includes providing texts on the public rights and freedoms and how to observe such rights.

Constitutions have been formulated to be respected ،the control over the constitutionality of laws and regulations، including the independent systems are achieved through two forms: The first form: political control، and the second form: judicial control.

In Jordan، control over the constitutionality of laws and regulations have passed through several stages.

Jordan seeks hard to become a state of law، and given that huge number of temporary laws، laws and regulations، the existence of a specialized constitutional judiciary through the establishment of a constitutional court under a constitutional amendment has become a national demand.

This national demand has been achieved through the amendment to the constitution of 2011، where articles 58، 59، 60، 61 in Chapter 5 of that constitution called for the establishment of a constitutional court.

Actually، on 06/07/2012 the Constitutional Court Act No.

15 of 2012 was issued، where the first article confirmed its validity one hundred and twenty days after its publication in the Official Gazette، the constitutional court commenced work on 06/07/2012.
