Abstract EN

The citizens’ debts constitute a major economic problem in many countries in the world.

In Kuwait, for example, this problem exists because oft، huge banking facilities offered to the firms and citizens, a matter which raised a number of legal questions regarding the possibility of writing off debts or loans.

This research discusses and analyzes this issue from an Islamic perspective and shows the flexibility and responsiveness of the Islamic jurisprudence to such emerging issues that confront the nation everywhere and at all times.

The researcher explained the terms stated in the title of the research, and proved the right of the government to interfere in such economic issues.

Evidence from the age of the Rightly- Guided Caliphs was provided and the relevant legal provisions pertaining to purchasing debts were explained by dividing the issue into two parts: Sharia rules regarding the government purchase of the debts of the citizens incurred on them by Islamic banks, and the proposed forms of these rules.

Sharia males pertaining to the government purchase of the debts of citizens incurred by conventional banks.

I explained how it can be permissible and under which conditions.

In conclusion, I presented answers to certain doubts that are often raised in this regard and proposed some recommendations
