Abstract EN

The purpose of this article is to examine the substantive conditions for urgent court hearing before the French administrative judiciary and its application in the field of basic freedoms, especially following the enforcement of Law on Urgent/Emergency Hearings before the Administrative Judiciary No 2000-597 in 2000.

These substantive conditions form the core of this theory: presence of final and executive administrative decision within one of the public and main freedoms, provided that this freedom is fundamental and protected by legislation, preventing the probability of having damages or consequences that cannot be prevented or avoided, serious reasons, and urgency.

The article concludes that it is necessary to have all these conditions so that the administrative judge can issue a decision to accept an urgent/emergency action and stop the execution of the decision until the case is settled
