Abstract EN

This paper aims at pointing out the importance of the penal judgments grounds in the Algerian legislation as it is considered as one of the most important constraints imposed by law to the Algerian magistrate’s freedom of conviction, in order to preserve the rights and freedom of the justiciable individuals and to get rid of defects and lacunae that may affect judgments.

Moreover, the present paper treats the problematic issue of judgments from the Criminal Court without any grounds because of their self-conviction character according to texts of the Penal Procedure Code.
