Abstract EN

This article discusses the civil war in Syria from a human rights perspective, starting from March 2011 until the present day.

The article attempt to monitor and diagnose the serious human rights violations, war crimes, and crimes against humanity, committed by different parties; whether the regime, the opposition, ISIS, or other groups and organizations.

Within five years, Syria has turned into the greatest tragedy in the twentieth century.

In addition to the humanitarian crisis resulting from the flow of Syrian refugees, there are war crimes and crimes against humanity that are committed on an ongoing basis.

It also was not possible to stop the attacks with chemical weapons, brutal methods of torture, as well as the massacres caused by explosive barrels.

The international community and the United Nations have failed to take effective measures to put an end to these crimes.

In addition, The UN Security Council failed to reach a solution with the consent of the Member States against crimes in Syria.

Until now, the United Nations has appointed three envoys to find a solution to this crisis, none of them has achieved any success.

Even a lasting cease-fire agreement in order to deliver humanitarian aid could not be reached.

After three years, the UN Security Council could only pass a resolution in February 22, 2014 in response to war crimes and crimes against humanity.

The Resolution No.

2139 urged all parties to the conflict to immediately stop the indiscriminate use of weapons in populated areas, and to stop the arrest, torture or, enforced disappearances of civilians, and to stop blocking the delivery of humanitarian aid.

When the Syrian government refused to comply with this resolution, the Security Council passed Resolution no.

2165, which allowed the delivery of humanitarian aid by the United Nations and its partners through the borders and lines of conflict.

Regardless of these unsuccessful resolutions, the Security Council has failed to refer the Syrian file to the International Criminal Court; because of objections of Russia and China in May 2014.

The international community must assume responsibilities in the investigation and prosecution of the perpetrators of war crimes and crimes against humanity in Syria, and take measures to refer them to the International Criminal Court.

Of course, if that happens, the bloodshed in Syria would stop, and similar crimes in different parts of the world would be prevented in the future.
