Arabic Abstract

تعد عقود الفيديك من العقود الحديثة نسبيا، و التي تم اعتمادها من الاتحاد الدولي للمهندسين الاستشاريين، و هي الأكثر شيوعا في تنظيم مقاولات البناء في جميع دول العالم، لأنها تضع إطارا تعاقديا مسبقا لتخطي مشكلات الإنشاءات الدولية و المحلية كما تنظم حقوق و التزامات أطرافها مع مراعاة التوزيع العادل للمخاطر، و بالرغم من دوره الكبير في الموازنة بين حقوق و التزامات أطرافه إلا أن التخوف من عدم ملائمة عقد الفيديك لأي بيئة يطبق بها خصوصا انه صنيعة مجموعة من المهندسين الدوليين الذين لهم باع طويل في مجال الإنشاءات، و مما لا شك فيه أنهم استقوا شروطه من بيئاتهم التي سبقتنا بالتطور التشريعي بكثير، إضافة إلى حاجته إلى تنظيم تشرعي موحد في الدول العربية، على اعتبار أن القوانين و الأنظمة المعتمدة لتنظيم أعمال المقاولات أصبحت لا تتلاءم مع الطبيعة المركبة و المعقدة و التطورات الحديثة التي بدأت تشهدها عقود الإنشاءات الدولية و ما أفرزته من تنوع في تنظيمها القانوني.

و لقد استهدفت الباحثة من خلال هذه الرسالة إلقاء الضوء على دور الفيديك في تنظيم أعمال المقاولات بعد أن تم ترجمته للغة العربية، من خلال الشروط العامة التي ترجمت حرفيا إضافة إلى الشروط الخاصة التي اعتمدتها كل دوله حسب بيئتها التشريعية بحيث تمت دراسة هذا الموضوع في فصلين حيث خصصت الباحثة الفصل الأول للتعريف بالفيديك و دوره في تنظيم التزام المقاول في مرحلة التحضير، كما تناولت في الفصل الثاني التزامات المقاول في مرحله الإنجاز.

و لقد توصلت الباحثة في ختام دراستها إلى مجموعه من التوصيات يعبر أهمها ضرورة تشكيل لجنة لترجمة عقد الفيديك مكونة من مترجمين محترفين أعضاء من نقابة المهندسين و نقابة المقاولين و قانونيين لتلافي الأخطاء التي قد تنجم عن التجربة و عادة صياغة الفيديك مع تجنب الإسهاب في النصوص و كثرة الإحالات التي تربك القارئ و تشتته.

English Abstract

Relatively, the fidic contracts is a modern contract, which has been certified by the international federation of consulting engineers, and the most common in organizing construction contracting all over the world, because it sets contracting framework in advance in order to skip all local and international constructing issues, as well as organizing parties' rights and obligations with equal distribution if risks.

Despite the considerable role in balancing the rights and obligations of parties, but the fear of fidic is not being suitable for any environment apply such contract, particularly fidic is being invented by a group of international engineers, who have a long experience in constructions.

There is no doubt that they drew its conditions of their environments that have preceded us much legislative development.

In addition, the necessity of a unified organized legislative in arab countries, by considering the accredited laws and systems which organize contracting activities is not suitable anymore with the complex nature and recent developments which being noticed in the international construction contracts with its legal organization diversity.

Through this study the researcher aimed to highlight fidic role in organizing construction activities after it has been translated to Arabic, through the general conditions which has been literary translated, alongside with the particular conditions which have been accredited by each country regards to its legislative environment, so it has been studied in two chapters.

The first chapter is to identify fidic and his its role in organizing the contractor's obligations in the preparation phase, however the second chapter is to identify the contractor's obligations in the achievement phase.

At the conclusion of researcher study, she reached to a set of recommendations, The most important recommendation is to form a committee to translate fidic contract consisting of professional translators and members of the association of engineers, contractors' association, and lawyers to avoid the errors that may resulted from the individual translators and reformulate the fidic, as well as avoiding dwell on texts referrals that confuse the reader.
