Arabic Abstract

جاءت هذه الرسالة لتقدم رؤية قانونية شاملة حول الإدارة الانتخابية في المملكة الأردنية الهاشمية، و الرقابة القضائية عليها، و بيان مدى كفاية الأحكام القانونية ذات العلاقة بعمل الهيئة المستقلة للانتخاب في إدارة الانتخابات وفقا للمعايير الدولية للانتخابات الحرة و النزيهة.

و قد تضمن الفصل الأول من هذه الرسالة مقدمة تمهيدية، و بيانا لمشكلة الدراسة و عناصرها و أهميتها و تعريفاتها الإجرائية، و محدداتها و حدودها، و الدراسات السابقة ذات الصلة بها، و منهجية البحث و إجراءاته.

و جاء الفصل الثاني من هذه الرسالة تحت عنوان القواعد العامة للإدارة الانتخابية من خلال مبحثين، عالج الأول مفهوم الإدارة الانتخابية و أشكالها و مبادئها العامة، و المعايير الدولية للانتخابات الحرة و النزيهة، و موقف المشرع الأردني منها، و تناول المبحث الثاني مهام الإدارة الانتخابية قبل الانتخابات، و خلالها، و ما بعدها، و العلاقة بين الإدارة الانتخابية و غيرها من مؤسسات الدولة، و العوامل التي تؤثر في أدائها.

و ركز الفصل الثالث من هذه الرسالة على الإطار القانوني للإدارة الانتخابية من خلال ثلاثة مباحث، تناول المبحث الأول مجمل ما يتعلق بالإطار القانوني لإدارة الانتخابات في الأردن، و نشأة الهيئة المستقلة للانتخاب، و استقلاليتها، و تركيبتها و آلية تعيين رئيسها و أعضاءها، و عددهم، و مدة العضوية، و الشروط الواجب توافرها للتعيين فيها، و حصانات رئيسها و أعضائها و مساءلتهم، و سلط المبحث الثاني الضوء على مهام الإدارة الانتخابية و صلاحياتها ؛ من خلال استعراض المهام التشريعية و التنفيذية لمجلسها، و مهام رئيسها، و أمينها العام، و هيكلها التنظيمي.

أما المبحث الثالث فقد تناول الإطار القانوني للإدارة الانتخابية في بعض الدول التي أخذت بشكل الإدارة الانتخابية المستقلة، و اختارت الباحثة كلا من تونس و العراق و كندا و الهند لمقارنة الهيئة المستقلة للانتخاب بها من حيث الاستقلالية، و التركيبة، و العضوية، و شروطها، و المهام و المسؤوليات، و الهيكل التنظيمي، و خلصت الباحثة إلى أن هناك تماثلا كبيرا بين تلك الإدارات في المهام مع وجود اختلافات شكلت بعضها إيجابيات أوصت الباحثة المشرع الأردني الأخذ بها.

أما الفصل الرابع و الأخير من هذه الرسالة ؛ فقد عالج الرقابة القضائية على العملية الانتخابية من خلال مبحثين ؛ تناول المبحث الأول الرقابة القضائية على الإجراءات التمهيدية للاقتراع، و إعداد جداول الناخبين، و شروط القيد فيها، و الإعلان عنها، و الترشح للانتخابات، و شروطه، و إجراءاته، و الرقابة القضائية على إعداد الجداول و الترشح للانتخابات، و الآثار المترتبة على الفصل في الطعن، و تناول المبحث الثاني الرقابة القضائية على الإجراءات المكملة للعملية الانتخابية، و حق الطعن في صحة العضوية و شروطه، و إجراءاته، و مدده، و الطبيعة القانونية للقرار الفاصل في الطعن، و الآثار المترتبة عليه، و خصائص الطعون الانتخابية.

و ختمت الباحثة الرسالة بمجموعة من النتائج و التوصيات و المقترحات لتعديل بعض التشريعات المتعلقة بالعمليات الانتخابية استخلصتها من دراستها التي خلصت فيها إلى أن إنشاء الهيئة المستقلة للانتخاب في الأردن يعتبر خطوة أساسية لبناء الثقة بمجمل العملية الانتخابية، و مهد الطريق لإجراء الانتخابات بطريقة حرة و نزيهة و وفقا للمعايير الدولية .

English Abstract

This study demonstrated a complete legal view of the Electoral Administration in the Hashemite Kingdom of Jordan, the judicial supervision on it, and presented the sufficiency of the Legal Arbitrators related to the work of the Independent Electoral Administration in accordance to the international criteria for free and fair Elections.

The first chapter of this study includes a preliminary introduction and clarification of the research problem, questions, significance of the study, procedural definitions, limitations and delimitations, the previous studies related to it, the methodologies searching and its procedures.

The second chapter of this thesis comes under the title of General Bases for the Administration Electoral through two topics, the first treated the Electoral administration concept, general forms, principles, the International Criteria for free and fair elections, and the position of the Jordanian legislator from it; the second dealt with the tasks of the Administration during the Electoral Cycle, the elections, the aftermath, the relationship between the Electoral Administration and other State Organizations, and the factors which affects its performance.

The third chapter of this thesis concentrated on the legal frame for the Electoral Administration through three topics, first is an overall relation of the legal frame for the Administration of the Elections in Jordan, its rise, independence, autonomy, the mechanism of designating its head and members, their number, period, and the essential conditions in abundance for the designation in it, immunities of head and members, and accountability.

The second topic concentrated on the Electoral Administration duties, and its competence; through exhibition of the Legislative and Executive tasks for its council, duties of its head, deputy and the Administration’s structure.

As for the third topic, it discussed the Legal frame for the Electoral Administration in some countries which adopted the Independent Electoral Administration form, and the researcher chose Tunisia, Iraq, Canada and India to compare with Independent Electoral Organization in terms of Independence, Form, Membership, Duties, Responsibilities and Structure and concluded that there are great similarities between the Administrations in their form and duties and even recommended the Jordanian Legislator to abide by some of them.

The fourth and final Chapter of the thesis; treated the Judicial Supervision on the Electoral Operation through two topics; The first dealt with the supervision on the preliminary measures for the vote, preparation schedules of the Electors, conditions of the shackle in it, announcement, candidacy for the elections, conditions, measures, supervision, resulting effects of the defamation.

The second topic concentrated on the Judicial Monitoring of the completed measures regarding the Electoral Operation, legality of the defamation, conditions, measures, periods, and the legal nature for the decision of the defamation, resulting effects, and Electoral characteristics of the defamation.

The study revealed some reached results, proposals and Electoral recommendations to amend some legislations related to the Electoral Operation extracted from the study which considered the establishment of the Independent Electoral Organization as the first step in building trust in the entire Election Operation in accordance with the International Criteria for enhancing free and fair Elections.
