Abstract EN

This study aims at investigating prophet's Silence, its importance and implications in the Islamic Fiqh.

One resource for understanding religious rules is the silence of prophet, which in contrary to his statements and actions is very complex and complicated.

Prophet’s silence on the issues, due to his innocence and his place in prophecy is a source of legislation.

The study indicates that prophet's silence about an issue is a sign of permission or accuracy of the issue in existence of conditions such as knowledge about issue, ability to deny, validity of issue and existence of no obstacle.

In some cases, due to some obstacles such as not existence of religious rule, fear of necessitation of issue and clarity of answer to questioner, prophet has been silent, which in these cases his silence is not the reason of any permission.
