Arabic Abstract

تهدف هذه الدراسة إلى استقراء، و استخلاص علل المعاوضات المالية عند الحنفية من خلال كتب الفقه الحنفي، و من ثم شرح هذه العلل-غالبا- و ذكر الفروع الفقهية التي تندرج تحتها. و قد تناولت هذه الدراسة في فصلها الأول أدبيات الدراسة و إطارها النظري، فبين الباحث مشكلة الدراسة، و أهميتها، و أهدافها، و الأسئلة التي تجيب عليها و المنهج الذي سلكه الباحث لبيان ذلك. و تناول الباحث في الفصل الثاني بيان معنى العلة و الألفاظ ذات الصلة بها، و بين أقسام العلة، و شروطها، و قوادحها، و صورها –عند الحنفية-. و في الفصل الثالث ذكر الباحث الفروع الفقهية القديمة لعلل المعاوضات المالية عند الحنفية مع بيان ما يتعلق بها –غالبا- و في الفصل الرابع ذكر الباحث بعض المسائل المعاصرة التي تعتبر تطبيقا معاصرا لهذه العلل، كبيع حق التأليف، و التأمين التجاري، و نحو ذلك.

English Abstract

This study aimed at investigating the reasons of financial compensations in the Hanafi doctrine by using the Hanafi books as well as interpreting these reasons – often- and mentioning the philological branches under which they are classified.

In the first chapter، this study addressed the literature as well as the theoretical framework; where the researcher demonstrated the study problem، importance، its objectives، questions and the approach that the researcher used to illustrate that.

In the second chapter، the researcher addressed the meaning of the reason and the vocabulary related to it.

He demonstrated the parts of the reason، its conditions، its pioneers، and images among the Hanafi followers.

In the third chapter، the researcher mentioned the philological branches of financial compensations in the Hanafi doctrine and mentioned the issues related to that.

In the fourth chapter، the researcher mentioned some of the contemporary issues that represent a contemporary application for these reason، such as selling the copy right، commercial insurance، and so on.
