An Islamic bank had issued a letter of credit, for a customer applied for the same. Since the customer could not manage the availability of the fund in its account when the documents under LC were negotiated and payment became due, the bank, under LC obligation, had to make payment from its own funds. Because the customer could only arrange that amount after one month, the bank incurred a loss of investment of that amount for that period. Shariah guidance is required by the Islamic bank on the permissibility either of : Charging the customer an amount that represents the profit of the bank for that period in respect of the amount that was paid by the bank to the beneficiary, Increasing the fee of issuance of next LC to the extent that indemnify the Islamic bank for the loss that it has incurred in the previous LC, Imposing an extra amount equal to the lost amount with the name of arrangement fee, Applying a delay payment penalty.
