Arabic Abstract
هدف هذا البحث لاستعراض و تحليل بنود و نصوص قانون الانتخاب رقم (6) لسنة 2016، و التعرف على الأقليات في الأردن بشكل عام بالإضافة إلى البحث في مدى دستورية كوتا الأقليات في هذا القانون.
توصل البحث إلى مجموعة من النتائج من أهمها أن قانون الانتخابات الأردني رقم (6) لسنة 2016 خالف مبدأ المساواة بين الأردنيين وعدم التمييز بينهم الذي أقره الدستور، عندما خصص و حدد مقاعد للنساء بموجب المادة (8/ب)، و أن نظام الكوتا يمثل إخلالا بمبدأ المساواة بين المواطنين كواحد من أهم المبادئ الدستورية، كما يخالف نظام الكوتا مبدأ تكافؤ الفرص لجميع المواطنين، و يؤدي نظام الكوتا إلى الالغاء الجزئي لصوت الناخب.
أوصى البحث بالعمل على تعديل قانون الانتخابات النيابية في الأردن و بما يتلائم مع مواد و نصوص الدستور التي تكفل لجميع المواطنين الحرية و المساواة بينهم دون تمييز، و ضرورة أن يتم تعديل القانون ضمن نطاق و اختصاصات السلطة التشريعية و خاصة فيما يتعلق بتقسيم الأردن إلى مناطق انتخابية.
English Abstract
The purpose of this research is to review and analyze the articles and texts of the Election law No.
6 of 2016.
Another purpose is to identify the minorities in general in Jordan, in addition to examine the constitutionality of the minorities' quota in the mentioned law.
A number of results have been reached in this research, the most important one that the Jordanian Election law No.
6 of 2016 breaks the principle of equality between Jordanians and principle of the inadmissibility of discrimination which has been passed by the constitution once the women's quota was created under the article No.
8/B.
Moreover, the quota system represents a breach of the principle of equality among citizens and this principle are one of the most important constitutional principles.
As well as the quota system breaks the principle of equal opportunities for all citizens.
Finally, this system leads to a partial cancellation of the voter's vote.
A number of recommendations have been mentioned in this research, firstly, the amendment of the parliamentary elections law in Jordan in accordance with the articles and texts of the constitution which guarantee Liberty and equality for all citizens without discrimination.
Furthermore, it insists on the importance of the amendment of the law within the powers of the legislative authority, especially with regard to the division of Jordan into electoral division.
