Arabic Abstract

تناولت هذه الدراسة حريات وحقوق العمال المهاجرين من منظور القانون الدولي العام و القانون الأردني، و الوقوف على مدى مواءمة القانون الوطني للاتفاقيات الدولية لحقوق الإنسان، و مدى كفاية التشريعات الأردنية لحماية العمال المهاجرين، حيث استعرضت الدراسة وضع الأجانب في المواثيق الدولية لحقوق الإنسان و مبدأ المساواة و عدم التمييز في الحقوق و الحريات الأساسية التي تكفلها الشرعة الدولية لحقوق الإنسان.

و تناولت الدراسة الاتفاقية الدولية لحقوق جميع العمال المهاجرين و أفراد أسرهم و ما احتوته من مواد تتعلق بحقوق الإنسان للعمال المهاجرين، ثم تناولت الدراسة حقوق و حماية العمال في اتفاقيات حقوق الإنسان ومعايير العمل الدولية، و ركزت الدراسة على دور منظمة العمل الدولية في حماية حقوق العمال المهاجرين و الاتفاقيات و التوصيات الخاصة بالعمال المهاجرين.

كما استعرضت الدراسة الإطار القانوني الوطني و مدى حمايته لحقوق و حريات العمال المهاجرين، من خلال الدستور وقانون العمل و قانون الإقامة و شؤون الأجانب، و مدى مواءمتهم للمواثيق الدولية.

و تم تحليل قرارات قضائية ذات صلة بالعمال المهاجرين و خلصت الدراسة إلى نتائج تتعلق بحماية العمال المهاجرين و قدمت بعض التوصيات لمواءمة التشريعات مع الحقوق و الحريات في المواثيق الدولية التي التزم بها الأردن.

English Abstract

This study examined migrant workers’ freedoms and rights from both the perspectives of general international law and Jordanian law.

The study then looked at the compatibility of the national law with the international conventions on human rights, and the adequacy of Jordanian legislation to protect migrant workers.

The study then reviewed the status of foreigners in international human rights instruments, focusing on the principles of equality and non- discrimination, as well as the fundamental freedoms guaranteed by the International Bill of Human Rights.

Then, the study reviewed the International Convention on the Rights of All Migrant Workers and Members of Their Families and the articles it contains on the human rights of migrant workers.

The study also examined the rights and protections of provisioned for workers in human rights conventions and international Laboure standards, with a focus on the role of the International Laboure Organization (ILO) in protecting the rights of migrant workers, in addition to the conventions and recommendations it made specifically for them.

Furthermore, the study explored the national legal framework and the extent to which it protects the rights and freedoms of migrant workers through the Constitution; the Laboure Law ; the Residence and Foreigners' Law; and their compatibility with international conventions.

Additionally, judicial decisions related to cases concerning migrant workers were also analyses as practical implementation of these laws.

Based on the findings it reached, the study in its conclusion provided some recommendations to better conform national legislations to conventions ratified by Jordan ; thus, securing the rights and freedoms guaranteed in these conventions to migrant workers in Jordan.
