Abstract EN

This study aimed at examining the reality of the mechanisms for protecting human rights in the Arab world as mentioned in both the Charter of the Arab League and the Arab Charter on Human Rights, in order to identify them first and to stand on their inefficiency in the field of protecting human rights.

These contractual mechanisms have also been compared with their regional counterparts in Europe, Africa and America in order to determine the point of weaknesses in the system of protecting human rights in the Arab world.

In this regard, this study aimed at proposing new mechanisms for further activation of the protection of the Arab human rights and fundamental freedoms; such as creating a new Protocol for Charter of the Arab Human Rights granting individuals and non-governmental organizations the right to submit complaints against the States parties, and follow up the process of establishing an Arab Court of Human Rights to work as an independent judicial body for promoting the safeguards of Arab human rights.

This study provided a critical analysis of the draft bylaw of the court and presented a group of recommendations that could be taken on board prior to the ratification of the bylaw by the Arab States and entering into force.
