Abstract EN

Ibin –Hazm Al-Andulusi is a pioneer in woman’s rights in the philosophical Islamic thought.

His writings about woman played an immense role in her position improvement and society’s perspective about her.

Her argued juriscensults who did not appreciate her value and doubted her potentialities and abilities in managing things.

He emphasized her equality within the limits of her specialty, rejecting any space for differences.

He supported his stance by verses taken from the Holy Quran.

These verses clearly stated that there is no female infanticide, forced marriage or financial custody.

Besides, she has the right to inherit and educate, etc.

Unlike other fanatic Islamic juriscensults, he did not aggrieve woman, nor hold her the social responsibility when a mistake is committed; on the contrary, he determined the concept of goodness for both.

He further criticized those who demand penalization on her part and blame her when she commits a mistake.

In this way, he equalized her with man within Allah’s set orders.

Accordingly, Aj-jihad for woman is not obligatory .

Moreover, doing pilgrimage and immigrating for the sake of religious knowledge is a must for her as it is for man.

As it is the case with man, expenses were imposed on her.

And she should further know regulations of cleanliness, prayers and fast also what is prevented from approaching food, drinks and clothes.

This does not mean that Ibin-Hazm has totally cancelled the differences between the two genders ; on the contrary, her confesses and limits it in the case of masturbation, where does not require to do her prayers and fast .
