English Abstract

This study examines the issue of a foreigner to own real-estate properties in countries in general and Sultanate of Oman in particular, for being one of the economic pillars of the states’ economy and significantly affect these countries in attracting foreign capital benefits and privileges which adds to earnings, attraction and means to attract and being in direct foreign investment with all its types and nature.

It is expected that any investor comes to the Sultanate, does not come for a brief period of a time, the meantime Omani legislator consent for having foreigners to own real- estate property in the Sultanate makes many foreign capitals remain in the Sultanate.

With other incentives make foreigners invest easily in the Sultanate.

The significance of this study stims from it sheds the light on legal issues relevant to foreign real-estate ownership in relevant states and legislations’ remedy for related problems.

The results of the study revealed that: In ancient civilization there were no consideration or importance given for any foreigner, even foreigners were not given even their basic rights foreigner, instead they were subjected to oppression.

As a result, and during medieval ages, countries started to enact legislations, to make life easy on foreigners residing on these countries.

Thus, foreigners gained some rights to be increased in the future.

The study’s recommendations are as follow: Omani legislators have to review the legal rules and laws relevant to real-estate ownership by foreigners, and to update such legal texts whether foreign or Arab investors involved.

In addition, update old laws to allow more facilities for foreigners to own real-estate property in Oman.

A note worth mentioning that some of foreign investment tends to have ill intentions.
