Abstract EN

The Reconciliation is considered as a special way of expiry of criminal proceedings.

It agrees with the penal policy that aims to find alternatives to short-term imprisonment because of its disadvantages.

Iraqi law regulated the Reconciliation in the Code of Criminal Procedure in articles 194-198.

The first type may be hold directly between the accused and the offender or his representative without the need to the acceptance of the court.

The second type is accepted only if the approval of the court The last type has the same penalty of the second type and provided that the court's approval for the conciliation is required.

If the judicial judgment is rendered in Reconciliation, the criminal case is completely dissolved and the judgment of the Reconciliation has the same effects of the acquittal
