Abstract EN

Acentral question in this research is suggested: who contributed first Principles of Islamic Jurisprudence, is it Sybawah or Imam Shafei? This attempt of assessing some facts of the linguistic and jurisprudence origins regards the common claim: the affect of jurisprudence origins on syntax that affected the modern grammarians, mainly Hanafi and Shafi’I.

The right spirit to edit or correct the false information based on what is determined by the ancient and modern grammarians and jurists, not by the latest, because it is not correct scientifically to present the latest determination believing that is the correct determination of the ancient grammarians and jurists era.

We cannot neglect the development and transformation of ideas and visions through times.

It is of the the importance of this research regards the syntax and jurisprudence origins that are not only a legislation for linguistic and Jurisprudential mind, but also for the Arabic mind.

This research is concluded in 6 studies: 1-Syntax origins and Jurisprudent origins (Nature, rationale, transformation from a knowledge to a science) 2-Origins ( Nature, function, impact and effect).

3-Language between (Sybawah and al-Shafei).

4-Theory of origins and branches between (Sybawah and al-Shafei).

5-The Major Origins or (Directing Rules) between (Sybawah and al- Shafei).

6-The fundamental rules between (Sybawah and al-Shafei).
