Scientific progress was followed by an evolution in the techniques of production and the innovation of many products that have proved to be dangerous and complex; And being his duty to make every effort to develop a sound product free of defects and risks, the producer, and due to the scientific progress and in light of the lack of the level of scientific knowledge at the time when the product is manufactured and put on the market, has become unable to anticipate nor predict the future defects and risks, and this raises the question of whether he is to be held responsible of possible future flaws resulting from scientific development which he couldn’t discover nor avoid at the time when the product was in circulation.
