Abstract EN

There are several ways of exploiting and investing in waqf properties; the most important one is the rent.

It is the most used way in the past and nowadays.

A variety of leases of real estate waqf was created, and the jurists clarified the rules of these different leases.

The Algerian legislator has included many of these ways in the legislation of waqf properties.

This study evokes the main problematic of the extent to which the Algerian legislator has succeeded in providing equal legal protection for the lessor and the lessee in the lease contract of real estate waqf.

I studied this problematic using the analytical method.

The goal of this research is to distinct the normal provisions from the special provisions in the leases of real estate waqf, and to define some legal issues related to these contracts, and try to find solutions to these issues.
