Abstract EN

This study addresses to the terms of the contract in Sudanese law compared with English law of contract.

This study can be abstracted as: The definition of terms of contract in Sudanese law is same as in the English law of contract, the terms of contract know in different legal system.

It has witnessed many legislation developments that based on some historical factors.

These development have taken place in many countries.

The terms of contract is of two elements: First the express terms.

Second Implied term which arise from the intention of the parties, or may arise from the previous transaction between them.

The implied terms also may arise from the custom, or by the court, or by the law.
