The foreign investment includes several positive impacts either to the country that export the capital or to the country that import it or to the investor who benefits from its rules.

The foreign investor, in seeking investment for his money, look for the country in which there are the legal rules that make the investing atmosphere table and attracting.

And this takes place by the balance between the parties in the investment relationship, which shows the rights and the obligations.

The law of investment, is the specific law that is considered as the tool of the country for presenting its policy in the case of the foreign investment from abroad.

Sudan, as one of the countries that is interested in development, in the time of lackness of money and in lack of capital required for development, has been in continual efforts for the sake of developing the organizing legislations that govern the investment, in order to save the requirements that motivate the foreign capital by presenting the stimulant and guarantee and by exposing the rights and the obligations of the foreign investor, so as to let them know their legal ground under the shadow of a velar rule.

The law of the year 2013, which encourage the national investment, save a lot of rights for the foreign investor, which aid in importing the investment as well as imposing some obligation.

It gives the foreign investor the right of possessing the land, and that the investor has the right of using the constructed part of it.

The law traces gradual rout in the case of applying the punishment upon the foreign investor when committing unlegal deed.

There is some defect in this law, as it does not show some important issues, such as asking the foreign investor to keep safe the environment and the social security, and to employ the local labour that is qualified and are able to carry out the same work that is needed by the project.

This involves completing the incomplete and birding the gabs so as to keep safe the national commonweal.
