Arabic Abstract

الرقابة البرلمانية لا تعني عرقلة الحكومة أو شل حركاتها في ممارسة اعمالها، و إنما تعني توجيه الحكومة و إسداء النصح لها و إبلاغها بموقف الرأي العام من سياستها، و التحقق من أنها تقوم بأعمالها على خير وجه، و أخيرا محاسبتها إن وجد ما يستوجب ذلك و لا يخفى على أحد أن الاقتصاد المتطور هو الدعامة الأساسية الأولى لرقي الدولة و تقدمها في جميع المجالات، و هو الدعامة الأساسية لبناء دولة قوية و آمنه و مستقرة و واضح أن الفساد المالي ينخر اقتصاد البلدان و يدمر و يهز اركانها لذا فالرقابة المالية البرلمانية ستكون الضمادة الأساسية للحفاظ على أموال الشعوب و عدم استباحته باعتبار البرلمان ممثل الشعب و صوته الناطق، و تعرف الدول التي تطبق مبادئ النظام البرلماني العديد من الوسائل التي يملكها البرلمان في سبيل ممارسة رقابته على مالية الدولة وأهم هذه الوسائل هي (السؤال - التحقيق – الاستجواب – سحب | الثقة) إضافة إلى الوسائل غير المباشرة لرقابة البرلمان وهي الاعتماد على تقارير الهيئات المستقلة، و قد تم تناول هذه الوسائل و مقارنتها مع الأحكام و النصوص التنظيمية لها في الدول المقارنة و كذلك السوابق و التقاليد البرلمانية بهدف الوصول إلى نظام قانوني برلماني أمثل يجعل هذه الوسائل سلاحا قويا يستطيع به البرلمان احكام رقابته على مالية الدولة

English Abstract

This study aimed at identifying forced labor in the light of international conventions and related Jordanian legislation by recognizing the extent to which the provisions of the Forced Labor Conventions No.

(29) of the year 1930 and the Convention on the Prohibition of Forced Labor No.

(105) of the year 1957 handle forced labor and the extent of harmonization, congruence and adequacy of the Jordanian legislative texts and their conformity with the provisions of the international conventions ratified by Jordan.

The researcher used the analytical descriptive method by addressing the texts of the international conventions in particular, as well as the texts of national legislation on forced labor, analyzing them logically, and showing their compatibility, as well as showing the strengths and weaknesses of each.

In this study, the researcher reached several conclusions, the most important of which is that the ratification by the Hashemite Kingdom of Jordan on the international conventions on fighting and reducing forced labor imposes obligations on Jordan to enact legislation that are compatible with the laws and prevents the enactment of any legislation or taking any measures that oppose the content of these agreements.

However, the reality of Jordanian legislation shows that it was insufficient with the contents of these conventions and did not show forced labor as an independent crime of its rules and elements, but touched some of the images of forced labor without its parts in a special law.
