Arabic Abstract

تناولت هذه الدراسة موضوعا لازال حديثا على البيئة القانونية و هو الحماية المدنية للمستهلك في العقد الإلكتروني، و الواقع أن ظهور التجارة الإلكترونية في عالم التجارة و الاقتصاد قد فرض واقعا جديدا من التعاقد الإلكتروني يجتذب الكثير من المستهلكين في زمن الاتصالات والتصرفات القانونية عبر وسائل الاتصال الإلكترونية، و قد بحثت الدراسة حماية المستهلك ضمن مفهوم العقد الإلكتروني في التشريع الأردني وذلك من خلال خمسة فصول، تناول الفصل الأول خلفية الدراسة و أهميتها و مشكلاتها و حلولها، أما الفصل الثاني فقد تناول مناقشة العقد الإلكتروني ماهيته و انعقاده ، في حين قد بحث الفصل الثالث المستهلك في العقد الإلكتروني من حيث بيان مفهوم المستهلك و طبيعة علاقته بالمزود و التعرف على الصعوبات القانونية و مبررات حماية المستهلك الإلكتروني، كما بحث الفصل الرابع نطاق حماية المستهلك في العقود عبر الإنترنت من خلال مناقشة حماية المستهلك الإلكتروني في ظل الضمانات التقليدية و الحديثة، ثم تناول الفصل الخامس النتائج والتوصيات التي خرجت بها الدراسة.

English Abstract

This study tackled still a new topic in the legal environment، which is the civil protection of the consumer in the electronic contract.

In fact، the emergence of electronic commerce in the field of trade and economy has imposed a new reality of electronic contracting that attracts many consumers at times of communications and legal behaviors via electronic means of communication.

The study explored consumer protection in the light of the concept of electronic contract in the Jordanian legislation in five chapters.

The first chapter dealt with the background of the study، its importance، problem statement and solutions.

The second chapter discussed nature of the electronic contract while chapter three discussed consumer protection in the electronic contract in terms of the defining the consumer and the nature of his relationship with the provider، as well as the identification of legal difficulties and justifications for consumer electronic protection.

Chapter four discussed the scope of consumer protection in online contracts through discussing the protection of electronic consumers under traditional and modern guarantee methods.

Chapter five presented conclusions and recommendations of the study.
