Arabic Abstract

تبرز أهمية الدراسة فيما يمكن أن تقدمه من معلومات و عرضها للاتفاقيات و القوانين التي تنظم عملية التحكيم في منازعات النقل البحري للبضائع.

و اعتمد الباحث في هذه الدراسة الدراسة المنهج الوصفي التحليلي و المنهج القانوني من خلال النصوص القانونية و الاجتهادات و الآراء والمنهج القانوني في إعداد الدراسة و استند الباحث إلى تجارب الباحثين السابقين في مجال التشريعات المقارنة في الفقه التقليدي.

كما عرضت الدراسة عقد نقل البضائع البحرية وفض منازعات عقود النقل البحرية للبضائع من خلال التحكيم وأثر التحكيم في فض منازعات عقد النقل البحرية للبضائع وقد توصل الباحث الى نتائج و توصيات كان من اهمها : انشاء آليات لتسوية المنازعات عن طريق التحكيم، سيؤدي الى الحد من تكلفة الجهاز القضائي على الاقتصاد الوطني كما سيساهم في التخفيف عن كاهل القضاء واستثمار الوقت و الجهد.

و كذلك لم يحدد قانون التجارة البحرية الأردني المقصود بمصطلح الناقل و المرسل إليه في حين حددت قواعد هامبورغ معنى الناقل و المرسل إليه ليشمل الوكلاء، و التابعين الذين يعملون لحسابهم.

و أجاز قانون التحكيم الاردني الطعن في حكم التحكيم الفاصل في النزاع، أما الأحكام التي تصدرها هيئة التحكيم أثناء سير الخصومة فلم يرد نص في هذا القانون يجيز الطعن فيها بشكل مستقل واصى الباحث بتوصيات من اهمها: نأمل من المشرع الاردني منح هيئة التحكيم سلطة إصدار حكم إضافي فاصل في الطلبات التي أغفلتها، و ذلك تحقيقا للغاية من اللجوء إلى التحكيم بالفصل في جميع الطلبات المتعلقة بالنزاع.

English Abstract

The importance of this study is highlighted in the information it can provide and its presentation of the conventions and laws regulating the arbitration process in maritime goods dispute disputes.

In this study, the researcher adopted the analytical descriptive approach and the legal approach through the legal texts, jurisprudence, opinions and the legal approach in preparing the study.

The researcher relied on the experiences of previous researchers in the area of comparative legislation in traditional jurisprudence.

The study also presented the contract for the carriage of maritime goods and the settlement of disputes of contracts of maritime transport of goods through arbitration and the effect of arbitration in resolving the disputes of the contract of maritime transport of goods.

The researcher reached the results of the most important: the establishment of mechanisms for the settlement of disputes through arbitration, On the national economy will also contribute to the mitigation of the judiciary and the investment of time and effort.

And also, The Jordanian Maritime Trade Law did not specify the meaning of the term carrier and consignee, whereas the Hamburg Rules defined the meaning of the carrier and the consignee to include agents and self-employed persons.

The Jordanian arbitration law allowed the appeal of the arbitral award to be settled in the dispute.

The judgments issued by the arbitral tribunal during the course of the dispute were not provided for in this law, which may be challenged independently.

The researcher recommended the following: In the applications that have been omitted, so as to make it very possible to resort to arbitration by adjudicating all applications relating to the dispute.
