Abstract EN

The appearance of Industrial Revolution has changed human food from natural and organic materials to transferred, preserved, and treated ones.

In spite of all this, human food has become harmful to the consumer’s health and safety, because the producer does not comply with the controls of production and manufacturing, and violates the rules and terms of consumption by the consumer.

As a result, the relationship between the two parties got disrupted, prompting the public authority to intervene to regulate this relationship to protect the consumer as a weak party, and to deter and restrain the activity of the producer as a strong party in the relationship.

It is believed that the commitment to safety principle gave birth to many commitments such the commitment to food safety, which is the responsibility of the producer or the mediator between the consumer and the producer.

Recently, this commitment has become a principle in jurisprudence and law, and was approved by Algerian legislature through Law No.

09 / 03 on the protection and the suppression of fraud and the subsequent regulation related to it.

This article aims at studying and analyzing the concept, its legal basis, and content to identify the mechanisms implemented in the light of Algerian Jurisprudence and legislation.
