Abstract EN

This study focuses on judicial reconciliation as a judicial litigation settlement mechanism in the commercial field.

As the settlement is of the procedures which lead to the termination of the bankruptcy and the return of bankrupt debtor to the capital, where they are subjected to conditions of the Judicial reconciliation.

The most important implications remains is to find out the safeguards that singled out the creditors to get their rights according to the principle of equality.

The procedure is carried on comparatively, especially with the Egyptian legislation as it gives a great importance to the subject
