Abstract EN

The different legislatives texts had imposed to the doctors as the others professionals, of free occupation to subscribe to an insurance to cover their civil and professional liability, in front of their patients, and every person concerned, in order to protect both the doctor and the patient from any prejudice which can touch the patient or anyone else as a result of medical mistake, defined as an error due to the ignorance of technical issues that any practitioner is supposed to know, or an error due to carelessness or to the lake of the appropriate attention.

If the responsibility of the doctor is confirmed in such matter, the insurance company with which the doctor or the health institution had signed the insurance contract will be obliged to compensate the concerned patient, according to the paid sums, the agreed ones.

Based on this principal, it became obvious, that the insurance which cover the civil and professional responsibility, guarantee the protection of both the doctor and the patient at the same time.

In addition the fact of insuring the security to the patient by convincing them that all the cautions had been taken , to protect them in case of medical involuntary mistake, make the system of insurance from professional responsibility in the sector of health and treatment, a gain for the patients and the doctors at the same time .
