Abstract EN

Subject of the research: Fatwas about different topics of Fiqh answered by the islamic scholar «Al-Faqih» Bin Qutlubugha, which are answers to six questions received by the author from some scholars.

The title of this paper, which is (The Judgement of «Khul» - divorce instigated by the wife - and the Hambali Position on it), is not consistent with its content.

The title suggests that it is competent to Khul, however, by looking at the questions recieved by the author it is clear that they address different topics of various Fiqh aspects.

Further, considering the author's answers - may God have mercy on him - it could be noted that they are not limited to the idiosyncratic side, but they have transgressed to the fundamentalist side and discussing some of the fundamentalism issues.

The paper also includes precise definitions of Fiqh aspects, which reflects the author's stature، the capacity of his knowledge, intellectual independence, and nondiscrimination of the doctrine.

Recommendations of the research: We recommend that researchers shall begin to study the Fiqh of the islamic scholar Bin Qutlubugha - may God have mercy on him -, and his fundamentalism opinions.

Moreover, because of the many scientific benefits, educational institutions need to be concerned with teaching manuscripts.
