Abstract EN

The purpose of this study is to find out the effect of the work through the strongest assumption in preponderance between the discrepant evidences by showing the degree of reliance of diligent on the prevailing belief in overbalance between the conflicting evidences and the result of that on the legal rules.

This study clarifies that the disparity of the suppositions among the diligent when overbalance such evidences was the main reason and the major factor in the existence of difference in many applied juristic issues.

Therefore, the researcher aims to study some methods of overbalance to show the effects and the applied juristic issues related to that.
