The rules of market require a legal framework to protect both competition and competitors.
To this end, civil penalties have been adopted with a view to suppressing anticompetitive practices.
However, the implementation of such sanctions raises a number of problems mainly related to the burden of proof on the plaintiff on one hand and the absence of criteria for an accurate assessment of compensable prejudice on the other hand, which severely affects the victims because of the diversity of the sums awarded by the judges.

Les règles du marché exigent de mettre en place un cadre juridique pour protéger à la fois la concurrence et les concurrents.
Pour ce faire, des sanctions civiles ont été adoptées en vue de réprimer les pratiques restrictives de concurrence.
Cependant, la mise en œuvre de telles sanctions suscitent un certains nombre de questions liées essentiellement au fardeau de la preuve incombant aux plaignants d’une part, et à l’absence de critères permettant une évaluation exacte du préjudice indemnisable, ce qui porte atteinte gravement aux victimes en raison de la diversité des sommes allouées par les juges.
