In the forty-fourth article of the Statute of the rule of the Kingdom of Saudi Arabia: « Consists authorities in the state of : • the judiciary.

• the executive branch .

• The regulatory authority ..

These authorities cooperate in the performance of its functions, in accordance with this system and other systems , and the king is a reference of these authorities .

And which stated in Article Sixty-seventh of the system itself : « competent regulatory authority develop rules and regulations , in the best interest , or raise corrupting in the affairs of the state , according to the rules of Islamic law , and exercise jurisdiction in accordance with this order and regular Council of Ministers and the Shura Council.

Noticeable than the previous two articles on the dispute from most Arab constitutions , they did not name the legislative authority on the one hand , on the other hand stated fittings and competence in another substance .

So why is this omission, I wonder? .

In order to answer this question and other sub-questions that are related to it, comes this intervention - if accepted - to discuss the reasons behind the omission or the consequences of not naming the legislature, to reach the final to judge this distinction , being an important base was supposed to be followed by other constitutions , or is that out exception to the general rule , and not necessarily known to work and constitutional jurisprudence
