Abstract EN

There are a lot of dilemmas surrounding the contemporary political studies in the side of legislative authority which require research and study, especially in regards of reference of this authority or the so-called sovereignty, to know whose responsible for its production and creation, so this study have an extreme importance, because it affect the core issue in all political thought, further it is the source of laws and legislations, moreover it is the basis of the political systems and its purpose, for this reason the Islamic political studies has attached great interest in this scope, Although it is a settled matter but it received wide interest of researchers and political Islamist thinkers.

This study comes to reveal the merits of Islamic law in the political part, and highlight its features through a brief view of the reference legislature and its substitute in a postural political system as stipulated in the Arab constitutions and Islamic political system, and through a comparison between the two, to reach the most important results and put some proposals for directing such studies and the advancement of such institutions to increase the level of performance and make it more effective.
