Abstract EN

This study deals with three chapters of the topic: « The guidance of the Prophet peace be upon him in dealing with prisoners» The first: I mentioned in it the meaning of captivity and its legitimacy.

The second: I have mentioned in it the material and moral rights preserved by Islam for the prisoner.

The third: I specified it to talk about the treatment of prisoners as applied by the Prophet peace be upon him.I have reached the wisdom behind legislating prisoning which is to break the enemy's power, push out its badness, remove it from the battlefield and exchange it with Muslim prisoners.

The Prophet has treated the prisoners well when he secured their material rights from food, drink, clothing and shelter, as well as their moral rights, while preserving their dignity and humanity.

The procedure followed with them is no more than one of four: Sympathy and amnesty or redemption or murder or slavery, either Sympathy and pardon was the most.

Such a treatment was not known by nations before or after, although the big amount of written convention and treaties about human rights.
