The administrative authority in Iraq, as a public authority, has the power to impose punitive sanctions on ordinary persons, on those with whom it has an organizational relationship, such as the employee or those with whom it has a contractual relationship, sometimes with a direct association, but has general authority derived from the rules of public law, under which the function of maintaining public order and suppress or prevent all that would threaten him.The follower of the legislative approach in Iraq and many countries of the world finds out the increasing the role of financial sanctions, including administrative confiscation, which have become apparent in many laws such as the traffic law, customs, media and communications and multiple images according to the criminal acts, and the administrative authority acquires its signature without the need to return to the judiciary, and routine procedures and achieve administrative effectiveness in preventing the departure from the legal rules or damage to the interests of the community materially or morally.

However, the recognition of the authority to sign the confiscation does not replace the agreement of jurisprudence, at the very least.
